CABELL COUNTY, W.Va. (WSAZ) – A man formerly employed as a shift supervisor at a residential treatment facility for adolescents is facing more charges following his arrest in August in connection with a sexual abuse case.

According to court documents, Austin Day has been charged with child abuse creating a risk of injury on top of charges of sexual abuse by a parent, guardian, custodian, or person in a position of trust to a child.

The child abuse charges stem from incidents that occurred between June and July 2024.

At the time of the alleged abuse, the criminal complaint states, Day was employed as a shift supervisor at Barboursville School located along Martha Road.

Court documents state Day is accused of going into a victim’s room and putting the 17-year-old in a chokehold.

The victim told law enforcement he could not breathe and feared Day would not stop.

The incident happened in the victim’s bedroom where other staff members could not witness the encounter.

The complaint is based on statements made by the victim during a forensic interview conducted by the Child Advocacy Center.

In August, Day was charged with sexual abuse stemming from an incident recorded in court documents that occurred between December 2023 to July 2024 at the same residential treatment facility where he was employed.
