Former “Jackass” star must remain in jail and undergo a drug and alcohol evaluation after a suspected DUI and probation violation, a Pennsylvania judge ruled Monday.
Margera, 44, was charged with a misdemeanor for driving under the influence of alcohol or a controlled substance last Wednesday after he was pulled over by police earlier in the week.
Monday’s hearing was to determine whether the charge violated Margera’s probation, which he was placed under in June as part of a plea deal to avoid jail time for two disorderly conduct charges. Those counts stemmed from a 2023 incident at the family’s home that involved physical altercations and threats.
Chester County Judge Patrick Carmody said Monday that the stunt man and skateboarder will stay in jail until the evaluation is completed, which could be as soon as Tuesday.
The judge cited Margera’s 2018 DUI in California as reason for not wanting him to drive a vehicle until the evaluation is complete.
After that, the court, probation and Margera’s legal representatives will meet and discuss next steps. If a deal can’t be reached, Margera will make another court appearance on Wednesday.
Margera’s legal team is aiming to get him into a rehab program of the probation department’s choosing, according to NBC Philadelphia.
“Everybody in the system — from the defense team to the prosecution to the probation office and the judge — are interested in seeing Bam get what he needs, which is not punishment, but treatment,” attorney William J. Brennan said outside the courthouse after Monday’s hearing.
Brennan described Margera’s relapse as “a little setback.”
