AUSTIN, Texas — The Austin Police Department on Tuesday released body camera footage and police audio related to a deadly officer-involved shooting that happened on Sept. 10 in North Austin.
A man, identified as Franklin Earl Miller, was killed in the incident after being shot by multiple APD officers.
According to APD, they received a top priority “prowler” call around 11 p.m. about an armed man trying to break into a business on West Anderson Lane near Lamar Boulevard.
The 911 caller said Miller was trying to get into her business by pulling on the doors. She told police she was watching on security cameras and saw Miller with a gun in his waistband and holding a rock.
APD said officers on the scene spent 14 minutes trying to deescalate the situation. According to the department, Miller placed his hand near his waistband and did not respond to commands to put his hands up. Police said throughout the interaction with officers, Miller “made sudden and exaggerated movements.”
Around 11:25 p.m., Miller allegedly raised the gun he was holding in the direction of officers. Five officers opened fire, while a sixth officer used a less-lethal pepper ball.
Those five officers have been named as:
- Officer Adam Korody, who has six years and seven months with APD
- Officer Nathan McCollum, who has one year with APD
- Officer Joseph Browne, who has four months with APD
- Officer William Gilley, who has eight months with APD
- Officer Daniel Jauregui, who has one year and nine months with APD
Officer Jeremmy Santos, who has four months of service with APD, was named as the officer who deployed his pepper ball launcher. Per APD protocol, all six officers have been placed on administrative leave.
Medics with Austin-Travis County EMS arrived on the scene around 11:30 p.m. to attempt life-saving measures on Miller, who was pronounced dead at 11:33 p.m.
No officers or other members of the public were injured during the incident. No charges are currently pending, though APD said the case remains under investigation.
APD released four materials related to the shooting on Tuesday, including 911 audio, police radio traffic audio, body camera footage from Officer Jauregui and patrol car dash camera footage from Officer Browne. They contain graphic content and language and viewer discretion is advised.
