MERCER COUNTY, W.Va. – A Bluefield woman charged in connection with the death of her child waived her right to a preliminary hearing on Friday.

27-year-old Robyn Lake Defibaugh was arrested Saturday and charged with one count of child neglect resulting in death.

Defibaugh’s criminal complaint reports she was sitting in bed holding her baby when Bluefield Detective Lieutenant D.A. Williams arrived at a home on College Avenue. She reportedly told officers she accidentally fell asleep in bed with him.

In a statement to Williams, Defibaugh allegedly said she went to sleep with her baby in bed before she woke up in a panic because she knew she had fallen asleep with her baby in bed.

Defibaugh allegedly said when she woke up her back was pushed against the baby’s face. She reportedly tried to wake the baby but he did not wake up.

It was noted in the complaint that Defibaugh said she always sleeps with her baby in bed.

Defibaugh was reportedly asked if she was under the influence of any alcohol, prescriptions or narcotics. Defibaugh reportedly told Williams she had drank a bottle of wine before falling asleep.

The criminal complaint says a wine bottle was later located in a kitchen trash can.

Defibaugh is incarcerated at Southern Regional Jail under a $100,000 surety/cash bond.
