MERCER COUNTY, W.Va. – The case of an Oakvale man charged with DUI resulting in death is heading to a grand jury in Mercer County.

Patrick F. Jones, 60, was arrested in October after West Virginia State Police allege he struck and killed Gregory Whitlow, 78, while Whitlow was riding his bike along Kellysville Road near Oakvale in September.

Jones appeared before Magistrate Keith Compton on Wednesday. During Jones’ preliminary hearing, West Virginia State Trooper First Class J.B. Fox alleged Jones had dilated pupils and later consented to a blood draw.

Fox said that components of suboxone were allegedly found in Jones’ system with levels above that for therapeutic use for those recovering from opioid use.

The next grand jury in Mercer County is set to convene in February. WVVA will continue to follow this case and bring you the very latest.
