WACO, Texas (KWTX/Gray News) – An 18-year-old Texas man who authorities say shot and killed a man who was changing a tire in his driveway reportedly told the victim “make sure you die slow,” according to arrest records.
Brandon Michael Davis, 18, is charged with murder following the Sunday incident, KWTX reports.
Officers were sent to the 1300 block of Old Moody Road in Eddy, Texas, on reports of a shooting. Dispatch informed police that two people were involved in the incident, and one of them had been shot, the affidavit states.
When officers arrived, first responders were providing aid to the victim, identified as Dustin Nobles, who had a gunshot wound to his upper chest. He was pronounced dead at 1:04 p.m. due to the wound, the affidavit states.
Davis was detained on scene, and police started speaking with two witnesses.
In a written statement, the first witness said he went to the home to wake Davis up and found Nobles outside the home, according to the affidavit. The witness said he woke Davis up and told him Nobles was outside and had taken a tire off his car.
The witness said Davis got upset and told his grandfather to tell Nobles to leave. The two had multiple problems with each other prior to that day, the affidavit states.
Davis’ grandfather went outside to tell Nobles to leave and, after coming back inside, told Davis it would take Nobles about 30 minutes to an hour to fix his car. The witness said Davis told his grandfather to tell Nobles he had 10 minutes to leave, according to the affidavit.
After going to the bathroom, the witness said he found Davis and his grandfather arguing as Davis pushed past him to tell Nobles himself he had 10 minutes to leave.
The witness said Davis went back inside to grab a weapon and pushed past his grandfather to go back outside.
The witness said he ran after Davis in an attempt to tackle him, according to the affidavit. Before he could, the witness said he heard Nobles say, “Come at me,” curse Davis and a pop.
The second witness provided a written statement saying an argument started in his driveway and Davis was holding a rifle, the affidavit states.
The witness said Davis warned Nobles several times to leave.
The witness said from what he saw, Nobles attacked Davis, and the gun discharged, striking Nobles in the chest, the affidavit alleges.
Police found a loaded .22 caliber rifle inside Davis’ bedroom and a .22 caliber shell casing in the driveway of the home near Nobles’ car, according to the affidavit.
Police say it was evident Nobles was working on his car since the front passenger side wheel was removed, the front of the car was resting on a jack and there was a tool bag with tools laying on the ground near the vehicle.
Davis was taken to the McLennan County Jail and subsequently interviewed by authorities.
Davis told authorities he was asleep in his bedroom when he was woken up and told Nobles was at his house. He said he became upset and grabbed his rifle to go outside and tell Nobles to leave, according to the affidavit.
While outside, Davis said Nobles got out of his car and started approaching him in an aggressive manner with no shirt on and his hands balled up in fists, the affidavit alleges.
Davis said Nobles did not have any weapons and did not make any threats towards him. Nobles was approaching Davis on foot when he shot Nobles in the chest, the affidavit alleges.
After being shot, Davis said Nobles yelled out that he was dead, and Davis replied, “Make sure you die slow,” according to the affidavit.
Davis said after shooting Nobles he went back inside, put his rifle back in his bedroom and waited for authorities to arrive. The affidavit alleges Davis told authorities he was not going to fight Nobles and instead shot him.
Davis is being held in the McLennan County Jail on an unknown bond.
