QUEENS, N.Y., (Gray News) – A woman in New York is accusing Arby’s of shrinking its portion sizes while keeping prices the same.

The New York Post reports that Melissa Nelson filed a lawsuit against the fast food chain, claiming that Arby’s is “deceptively” continuing to sell its fries and beverages in smaller sizes without lowering prices or notifying customers.

Lawyers in the lawsuit claim that when Arby’s phased out its kid’s size for fries and drinks it just changed those to small sizes with the small size becoming medium and the medium becoming the new large size.

The lawsuit follows the introduction of the Shrinkflation Prevention Act last year, which treats “shrinkflation” as an unfair or deceptive practice.

According to the lawsuit obtained, Nelson is seeking to represent customers who purchased French fries and beverages at Arby’s when it comes to the change in portion sizes.
