BECKLEY, W.Va. – A lawsuit related to the former Raleigh County Circuit Court Clerk and an alleged toxic work environment has been dismissed after issues raised by the plaintiffs have been addressed.

Robert Dunlap, attorney for the plaintiffs, said former Clerk Robert “Bob” McComas resigned in February 2024 shortly after Raleigh County initiated an internal investigation into accusations related to misconduct in the workplace. The civil action by former county employees was filed in May 2024, alleging acts of harassment, racial discrimination, retaliation, and violation of the Whistleblower Act, among other accusations.

Dunlap said the Raleigh County Commission in response to the allegations has publicly committed to partnering with two reputable human resources firms to ensure improved adherence to workplace policies moving forward.

“The fact that Mr. McComas has resigned in light of the egregious allegations detailed in the complaint, coupled with the County Commission’s decision to strengthen HR oversight, demonstrates real progress,” said Dunlap in announcing the decision. “The plaintiffs pursued this case not for personal gain but to protect all Raleigh County employees from discrimination and workplace hostility.”

Dunlap said the Commission, as one of the county’s largest employers, has now committed to stricter adherence to workplace policies that address racial, sexual, and other forms of discrimination and that the plaintiffs expressed their appreciation for the overwhelming public support received throughout the two years leading up to and during the lawsuit.
