CHARELSTON, W.Va. – The West Virginia State Senate has passed a bill where a failed drug test under certain circumstances would bar an applicant from receiving unemployment benefits.
House Bill 2441 amends §21A-6-3 of the code of West Virginia to include “failure” of a drug test “in an employment position where alcohol or drug use creates an inherent risk to the health and safety of the employee or others, or employees” to a list of reasons that exclude someone from receiving unemployment benefits.
The bill now heads to the House of Representatives.
