A Sheriff is to probe the death of a man who was hit by an Edinburgh tram as he walked home after work.

Carlos Hernan Correa Palacio died after he was struck by a tram in the Saughton area of the city on September 11, 2018.

The 53-year-old was trying to cross the road at a pedestrian crossing after ending his shift just one month into a new job working as a bus driver.

A preliminary Fatal Accident Inquiry (FAI) will take place at Edinburgh Sheriff Court on February 3, 2025

The FAI itself will take place on the weeks commencing March 24, March 31 and April 22 at the same court.

It comes after Edinburgh Trams were found guilty of breaching the Health and Safety at Work act at Edinburgh Sheriff Court on August 24, 2023.

Crash records showed that two warning alarms were sounded before the fatal collision but determined the tram was going faster than advised.

The tragedy sparked an immediate change that saw trams fitted with louder bells and pedestrian crossings were cleared of all plant life and structures to improve visibility.

The organisations represented in the inquiry include: tram operator Edinburgh Trams Ltd; the Rail Accident Investigation Branch; the Office of Rail and Road; and the Light Rail Safety and Standards Board.

Carlos’ devastated relatives said in 2022 that they were still waiting for answers and this was adding to their grief.

In a statement, Carlos’ grieving family said: “We are at our wits’ end. We’ve waited and waited and put our faith in the justice system but it gets to a point where you can no longer assume that ‘no news is good news’.

“We need prosecutors to tell us what is going on. If there is a delay, then why? If they need more evidence, then what evidence?”

Earlier this year, Procurator Fiscal Andy Shanks, who leads on death investigations for the Crown Office and Procurator Fiscal Service, said: “The tragic death of Carlos Correa occurred in circumstances giving rise to significant public concern and as such a discretionary Fatal Accident Inquiry will be held.

“The lodging of the First Notice enables FAI proceedings to commence under the direction of the Sheriff. Mr Correa’s family will continue to be kept informed of significant developments as court proceedings progress.”
