A woman who smashed the window of her ex-partner’s car has been ordered to pay over £1,600 in compensation.
Boozed-up Wendy Miller threw a brick through the rear window of her ex-partner’s car, causing it to smash, on June 5.
On the same date, the 59-year-old caused “fear or alarm” in Renfrew’s Fulbar Street by repeatedly shouting, swearing and uttering offensive remarks at her ex’s home.
Miller’s “appalling” behaviour was also in breach of a bail order that had been made at Glasgow Sheriff Court in April preventing her from contacting or approaching her ex-partner.
The procurator fiscal depute told Paisley Sheriff Court the accused and the victim were previously in a one-year relationship with that coming to an end in April this year.
She explained: “Around 1.30pm on June 5, the complainer returned home from shopping and parked her car, locked it and observed no damage to her vehicle. Around 11.15pm, the complainer was within her home address and heard banging at her rear windows.
“She went into her kitchen and saw the accused. She then went out to the garden and asked the accused to stop when the accused shouted, ‘f**k off, fat b*****d, ugly b*****d’ and similar.
“The accused then also shouted, ‘f**k you, you’ll pay for this’, then walked off and the complainer returned inside and locked the door. Miller walked off towards Fulbar Lane and the complainer then heard a loud banging sound and observed the accused running from her car.
“At this time, a neighbour was checking their Ring doorbell and was able to observe the accused walk towards the vehicle and then heard a loud smashing sound followed by the accused running off.
“The woman attended at her vehicle and noted the rear window was smashed, there was a dent on the roof and a brown brick in the driver seat footwell. She took pictures of the damage, went inside and phoned the police. Officers attended at the accused’s home on June 6 but failed to trace her there.”
The town’s court heard the cost of the damage to the woman’s car totalled £1,673.18 – which she was forced to pay out of her own pocket. Defence agent Paul Gallacher told the court this was “appalling behaviour in many ways”.
He added: “Ms Miller has had a long-standing issue with alcohol and, at the time of the offence, she was under the influence of alcohol.
“It is my position it would benefit her and those around her if the court imposed a community payback order with supervision. She is also keen to recompense the complainer for the damage she caused.”
Sheriff Colin Pettigrew stated: “I agree with your agent, that the conduct was appalling and I accept alcohol had a part to play. Based on what I’ve read in the report and what I’ve heard, there is a direct alternative to custody available.”
Sheriff Pettigrew made Miller, currently of Broadholm Street in Glasgow, subject to supervision of the social work department for 18 months with the requirement she attends alcohol services as and when directed.
In addition, she was ordered to pay £1,675 in compensation to her ex-partner as a “direct alternative to custody”.
