AUSTIN, Texas — A jury in Williamson County has awarded a family more than $1 million in restitution for health problems caused by mold and pests in their Cedar Park apartment.
According to the lawsuit, the family sued the Whitestone Crossing apartment complex in 2022, claiming that the owner didn’t repair water leaks in their apartment. The unfixed leaks then caused mold to grow, contaminated their belongings and created an uncontrollable pest problem.
The lawsuit says the leaks were caused after water started pouring through their doors during thunderstorms. Maintenance then refused to repair the leaks, claiming that the leaks were the fault of the builders not putting in rubber seals. Subsequently, the ongoing leaks caused ants to infest the apartment and bite the family.
A mold expert who inspected the apartment also told the family that they had dangerous levels of mold but the apartment’s management company refused to fix it, even as the family experienced health problems like sinus infections, asthma, swollen glands, short-term memory loss and exhaustion.
